He is waiting for the court decision, otherwise being current right now is a moot point.

When/IF judge Zurn does the logical thing here, Berry will get the ball rolling ASAP. I am quite certain IMHO that everything is already in place and that the court decision is all that stands in the way of $1.00+++++++++++++

Furthermore, as i have stated in the past, Berry would not have undertaken this endeavor (time/Money/work) if he did not feel the odds were greater than 50/50 for a successful resolution.
No businessman would have touched this for 50/50 odds, the casino is way easier, less painful, and lots more fun 😂
