Does a legal entity need permission transfer an asset it owns to another entity it owns without permission from the lender? But what about transferring that asset to another legal entity it DOESN'T own? The big question seems to be whether Hamilton Street Associates LLC also owns SPOOZ. As posted previously
2) On 4/4/2017 Park was listed as the registered agent for the formation of G2 FINANCE LLC whose stated business purpose is "raising up EB5 investments." The "EB-5 Immigrant Investor Program."
3) Sometime around 2019 the complex at 510 Hamilton was constructed (see Pavicic photo below) . I've not found any evidence that Park provided any EB-5 foreign investors to help fund that project. Online sources indicate JKP has lived in a 4th floor apartment. The phone number to lease an apartment is tied to him via his defunct "5 Loaves & 2 Fishes" charity which IMO means he manages the complex. He also manages and may own the Korean BBQ Grill in the complex. IMO he may well have gotten an EB-5 investor to pay for that.
4) On 6/6/2022 the HSA LLC was amended to add JKP's FINANCE LLC as a ''member'' of Hamilton Street Associates LLC. JKP also appears to be the registered agent or that filing. -----------------------------
