If he is wrong which a majority of professionals have stated that he is and the 11th does indeed have the power, why would this judge make such a comment?
I would say it is he who is confused and confusing the issue. Which is a hell of a lot more important than a nobody like me on a random chat board questioning his position and reasoning.
