"Could TX, Hold an evidentiary hearing invoking the 25th? "
Shows you what a complete asshole you are. The cabinet has to do that.
The 25th amendment provides for the temporary transfer of the president's powers and duties to the vice president, either on the initiative of the president alone or on the initiative of the vice president together with a majority of the president's cabinet.
Whenever the Vice President and a majority of either the principal officers of the executive departments or of such other body as Congress may by law provide, transmit to the President pro tempore of the Senate and the Speaker of the House of Representatives their written declaration that the President is unable to discharge the powers and duties of his office, the Vice President shall immediately assume the powers and duties of the office as Acting President.
I'm not arguing with the SC decision. I thought the CO case was problematic. But you have the logical skills of a mental deficient, you talk out of both sides of your mouth, and you're an inveterate liar. Typical junkie.
J. Michael Luttig made the argument for removal under the insurrection clause. As conservative legal minds go, he's considered to be among the heaviest of heavyweights.
