I'm not saying SCROTUS will refuse the state of CO appeal, they already have it in their hands, they will rule on it.

I say there is a serious question of whether or not they will take the immunity case appeal. The 3 judge appeal panel took it's sweet time, I think, with an eye toward giving the SCOTUS nowhere to go, nothing to add.
