It was always anticipated that he would play a more behind-the-scenes role — organizing the sprawling investigation, running the grand jury process and hammering out immunity deals. He is always a presence in the courtroom, with natty attire that includes colorful pocket squares and occasionally ascots. But he generally defers to deputies for courtroom arguments.

John Floyd represents plaintiffs and defendants at the trial and appellate levels
in cases involving business torts, the federal and state Racketeer Influenced and
Corrupt Organizations (RICO) statutes, health care and professional liability. He also
conducts internal investigations for institutional clients.
John is the author of the only book on state RICO statutes, RICO State by State: A
Guide to Litigation Under the State Racketeering Statutes (American Bar Association,
Section of Antitrust Law 2011 and 1998). He also served as a Special Assistant
Attorney General for the State of Georgia in its largest RICO prosecution and the
companion civil RICO forfeiture action and was a Special Assistant District Attorney
in the successful prosecution of Sidney Dorsey, the former sheriff of DeKalb County,
Georgia, on charges including murder and RICO. After the Dorsey case, John was
made a member of the National District Attorneys Association’s Heavy Hitters club
for his “outstanding work in prosecuting a complicated, difficult, high-profile case that
ends with a guilty verdict.” He then successfully argued for the affirmance of that
conviction before the Georgia Supreme Court.
John is a frequent lecturer, and has published numerous articles on business
litigation issues such as RICO, the False Claims Act, and internal investigations.
He has also served as chair of Georgia’s ICLE RICO Seminar and as a co-chair of
Georgia ICLE’s Internal Investigations Seminar. John is often asked to speak with
district attorneys organizations on RICO and White Collar Crime topics.

¦ Successfully represented a natural resources entity in obtaining an injunction
preventing unauthorized mining on the clients property.
¦ Successfully represented a county school district in an investigation of fraud
and waste in the construction and renovation of school buildings that resulted in
recoveries and savings of several million dollars.
¦ Represented a putative class in a federal and Georgia RICO action involving the
employment of illegal workers.

¦ Obtained dismissals in six cases in a row over the last three years.
¦ Represented a publicly traded corporation and its subsidiary in an investigation
concerning alleged receipt of stolen property.
¦ Represented a defendant accused of participating in a major theft ring; the case
was settled at a relatively low amount, re-establishing a business relationship
between the defendant and the plaintiff company, and insulating the defendant
from a pending criminal investigation.
RICO as special prosecutor
¦ Helped prosecute administrators and educators involved in cheating on
standardized tests in the Atlanta School System. The case resulted in 21 guilty
pleas, 11 convictions (including 11 Georgia RICO conspiracy convictions) and one
acquittal.
¦ Helped convict the former sheriff of DeKalb County, Georgia who ordered the murder of his elected successor;
successfully defended the conviction in Georgia Supreme Court.
¦ Helped convict two members of the faculty at The Medical College of Georgia who had stolen over $10 million in
research funds; recovered 99 percent of the stolen funds.
