Joe its not Maxim doing the main naked shorting, they are the broker finding the hfunds to buy the offering. Their warrant size represents a small percent of the overall offerings (.04%) & Maxim has to pay Sintx to exercise those warrants. So we can take your scenario and immediately apply it to the hfunds that bought the offering; which is effective as of last night so no Sonny pulling the offering and the offering is NOT being repriced. Its the hfunds that made the $1.6m you describe. Also they NAKED shorted on news of the R&D contract with the army, thus they NAKED shorted from .25-.50 range making alot more than the $1.6m you mentioned. If every .1 represents $1.6m profit then if they have an average Naked short position of .35 then that translates to $3.2m in 24 to 48 hours. Essentially funding the offering in 1-2 day period. Thats a no risk and no brainier for whichever hfunds participated in this. From the looks of it they were waiting for the right news to orchestrate this which is why News always comes with these offerings.

They have to do these naked short movements in quick strike movements like this because if they hold the naked positions too long it could open up a review by the SEC...although unlikely.

The ultimate question is does Sonny continue to do these types of offerings because he has to and the funds take advantage of the situation to guarantee profits?
