I have heard the case is getting tossed for a year - why wouldn't it have been tossed when it was first filed?
The SEC has never filed a complaint against Calasse for securities fraud - the SEC made Sharp return the Calasse stock - when Sharp attempted to steal the Calasse stock.
Sharp lied in District Court about Calasse not existing. Plus, Sharp didn't provide proper service to Calasse.
When Calasse filed a Form 4 about receiving the stock the SEC didn't find any fraud involved.
If it was going to be tossed outright, I think they would have tossed it a year ago.
I think they entertain the current arguments and issue a decision based on jurisdiction. Won't get to the question of fraud like some want, there are clearly preliminary issues that will decide the case, IMO.

I'm expecting Calasse to "win" in some way, as Sharp clearly didn't follow proper procedures to cancel the shares. It's obvious when you compare WNFT to GVSI.
But I don't think there will be any winners in this fiasco. We all lose. Calasse winning doesn't mean much if Sharp walks away out of spite.
