It's a proposal based on Albright's very own governing procedures. Of course Amazon is going to try and delay for as long as possible, that's part of their game. You also have to remember that Amazon asked for a stay on the case until the 606 re-examination completed, which was not granted.
The Joint CMC motion was filed/proposed by VP on June 26th, 2023 after the amended claims construction (Markman) was granted on June 12th, 2023. Therefore, Hudnell's proposed date of May 28th, 2024 already took into consideration the extended markman. IMO, Albright holds close to a May/June trial date.
I'm sticking with a close to May/June date for Trial. IMO, that's still a valid trial date, we just haven't seen it set in stone from Albright yet, but again IMO we should hear soon. Amazon has exhausted their Alice motion responses and i think its time for Albright to decide on that.
