In Collin's the 5th Circuit Panel ruled against the Plaintiffs but the opinion seemed to have some favorable ancillary holdings. Judgement was final in early December. I had thought it was going to be appealed En Banc but I am not sure if that is still possible or not. It would make sense to wait as long as possible because the SCOTUS CFPB case would be precedent on any Appropriations clause issues and potentially other separation of powers issues since the SCOTUS case is an appeal from the 5th Circuit. I am just wondering what is the deadline to appeal Collins to the 5th Circuit En Banc?
