However, when a party withdraws an appeal, it may mean that the parties have come to some sort of agreement outside the court proceeding. Sharp did mention an agreement of sorts with the SEC, which lead to the appeal being withdrawn.
Yes, I do agree that it doesn't change the original decision by FINRA, however, considering that these corporate actions were attempted to be undertaken by previous management, and that so much time has passed since then and there have been changes in material circumstances, it does open up the possibility that there was some agreement that if Sharp withdrew previous management's appeal, then FINRA would entertain a new application for corporate actions.
This is a definite possibility, and is the best Sharp could hope for.
