Maybe you are thinking of a no action letter? That simply means the SEC isn't pursuing anything further actions against MIKP. Remember, they already handed down their stiffest punishment to MIKP, booting them to the illiquid gray market. A no action letter doesn't say, 'no fraud committed'.
The SEC already had proof of the securities law violations before they suspended the ticker.
