So you are saying old Equity holders (Preferreds & Commons of LBHI, not CTs) are TOAST...I am not sure about your interpretation. I don't think what you are saying would be compliant with SEC/IRS Rule 382-B that defines the pre-requisite conditions for the Emergent company to utilize the NOLs.
