Without prejudice means he can re-file. My bet is that he is looking for another court where the judge in a civil case will not look at competency and charge him thousands of dollars for a psychological evaluation. Not to mention his divorce case that I guarantee will be very messy and expensive has him totally off the rails.
If Eddie Vakser is stupid enough to file again elsewhere, he may be in for quite a surprise. Mezey will have a total field day with discovery. He will have a gargantuan fight on his hands as we have seen already.
Sanctions don't happen all that often in Texas and it would be silly to pay an attorney to fight that as Eddie may really be close to destitute. So much for Eddie's big pre-paid case and his class action that was to include all of us nasty naysayers. Eddie looks like a total buffoon once again.
