The markers ALONE should be a clear enough indication that there were 2 classes of ownership THOSE BEFORE the OWNERSHIP CHANGE and those after and only those before the OC THAT ELECTED TO PARTICIPATE WILL PARTICIPATE.

Lets do it this way, I own a home I have an insurance claim while I was paying the bill, I file the claim and then decide to sell my home, THE NEW OWNER HAS NO RIGHTS TO MY INSURANCE CLAIM just because the insurance co as taken 6 months to ply my claim, I OWN the claim becasue I owned it at the time and file while I owned it
