It's true that Judge Sweeney denied the government's motion to dismiss our two 5th Amendment derivative cases, as well as Fairholme's (Barrett). But, Barrett's petition appealing the Federal Circuit's horrible 2/22/22 decision was one of the four petitions SCOTUS denied.
What Fisher appealed, was his Derivative Claim, jointly with all other 11 related cases: Fairholme, etc., that was re-appealed in the Supreme Court after being dismissed. Judge Sweeney only allowed the Derivative claims to proceed to the U.S. Court of Appeals for the Federal Circuit and the Direct claims were dismissed for lack of jurisdiction.
