Yes, fnf is responsible. But, fhfa runs the show and is the show. Basically money going to damages is not going to treasury. So, you label it however you want. I do not care as long as they reserve during an appeal if hamish wins. And continue to pay accordingly into the reserve over time during the appeal.
I tend to say we are suing fnf like what Royce said...tomato...tomatoes...whatever....go figure
