You contradict yourself in the post. You begin by saying it’s dead but the rest of the post indicates you’re well aware it’s not dead. The only reason SCOTUS hasn’t decided yet whether they take the case or not is the government requested a delay in filing their response. SCOTUS has plaintiffs’ filings. They need the government’s.

Fairholme is not dead, instead, the government is trying to figure out an excuse to delay this past the election because they know they will lose.
