My point is that the Government won't pay damages - and has no reason to - as it can settle by other means - such as ending the conservatorship.

Does anyone know if the trial is still on for Oct 17?

Unlike lawsuits where you can sue anybody, at any time, for anything, appeals are a bit different. You can appeal a decision but you must have grounds for that appeal. Fluff is not a valid reason and that's all the government's got now.
