There is a distinction between “OTC” and “penny stock”.

Not all “OTC” stocks are penny stocks, and not all “penny stocks” stocks are “OTC”.

The regulation only applies to “penny stock” as defined by the SEC unless it is penny stock “exempt”.

In the case of GVSI…safe harbor protections for forward looking statements is not available.
