If Tesla was insolvent, if Tesla was a one man band, if Tesla was at a critical juncture in their existence, if Tesla was in the middle of an appeal/legal issues etc etc etc - then yes, diverting effort/resources to a new venture would probably not be a fan favorite of current shareholders.
