Well not really ... if you look at every one of Adar Bays lengthy of lawsuits for the exact same thing and frivolous claims the courts have set quite a precedent as well and never awarded the exhorbant damages they have claimed or forced share issuance ... the cases either get settled or the court awards them the cost of the loan and interest. That is not speculation.
