That could happen, but it would of helped their cause to not include Kim and Yun-Gen as inventors in the patent apps. I think Notre Dame understood the difficulties of getting permission, certificates, and doing business, in foreign countries, better than shareholders.
It doesn't matter who the inventors are. They have no rights in the patent. The only entities with rights to the patents are the patent holders. Notre Dame is the patent holder in question. It is possible that Notre Dame will get impatient with KBLB and decide they can make more money with another company. Who could blame them?

KBLB may write a 'cease and desist' letter, but it really needs to come from Notre Dame if they own the patent. They are the ones who can enforce the patent rights, not KBLB. This is pretty much a formality. If KBLB identifies anyone infringing on the Notre Dame patents, they will notify Notre Dame. Notre Dame will take over from there. Notre Dame has a vested interest in defending their patents in order to retain their licensing fees. Part of the service KBLB is paying for, I suppose. Anyway, I assure you that Notre Dame's lawyers are fine.

We have no idea about the quantity of silk produced, other than an indication it sufficed for the launch of Spydasilk, an unknown quantity. If they have produced a few ounces of the highest quality silk in 10 months, I'm not impressed.

Well, Randy Lewis has filed a patent application to cover exactly this process. Not sure if KBLB is using the same technique or not. If so, and if the patent is ever awarded, KBLB will need to license the technology or not use it.
Interestingly, Randy Lewis has just received a patent from the US to create silkworms that spin spider silk. This patent identifies a way to better anchor the spider genes to allow generation-over-generation consistency. By just, I mean August 17, 2021.
This is a significant event. Randy Lewis knows about the claims made in the Notre Dame application and has likely found a way around those claims to make silkworms that express spider silk with generation-over-generation stability.
At the current moment, neither Thompson nor Notre Dame can challenge this patent in the US. But Notre Dame can enforce their patents in the EU if there is a conflict. Hope Thompson can afford to license from Utah State. That would prevent others from using that technology.
