And then there's common sense and just doing what is right .

Certain words come to mind:

Honesty
Integrity
Decency

I know why the boilerplate verbage is included.

So you're saying that if a CEO or other Co. official knows that things are going South they shouldn't say anything ?

Hiding behind that kind of disclaimer speaks volumes to ones character.

But I'm sure "since they all do it" it's ok.

What portrays a better picture of a struggling, growing Company?

1. Being transparent and honest and have your SP steadily decline.
2. Being non transparent and evasive and have your share price decline.

Both are bad for the shareholder but one is considerably more damaging.
