Its an opinion, and I have not (mis) represented "my opinion" as a fact. Indeed, it would likely be Scotus who decides, with certainty, if Alito's statements were dicta or not.
Many others mis represent "their own opinions" as facts. I think my wife is the prettiest woman in the universe.
