Can't call me an Alito lover or Conservative for replying to your post. However, I've pondered the same point when I read his opinion and have concluded that what he's saying without saying it is the Conservator may act in publics best interests because of eminent domain laws where private property may be taken for a higher public good. IMO, the SCOTUS has given FnF shareholders the green light to pursue a takings claim in the lower courts where they were blocked before. Time will tell.
