My thoughts exactly. It seems that FHFA can hold the GSEs in perpetual conservatorship for eternity because it is in the best interests of the FHFA and that is with the SCOTUS blessing -- so good luck overturning that.
That is why I liquidated everything because even if the GSEs retain capital back to adequate levels the FHFA may still choose not to release and have the power and authority to do so.
With this ruling the GSEs were re-chartered with HERA.

In a way, this ruling reminds me of the emminent domain issue in Kelo. In that case SCOTUS ruled that the local govt could take lakeside property to sell to a developer to increase the taxable value. Turned the meaning from public use to public benefit. We have just been abused by the same thought process. The 'agency' is the public so its ok if they swipe assets for public benefit.
