What people are forgetting here is the simple fact that, DA BOYZ GOT CAUGHT.
At one point they were the LAST MAN STANDING in this BK holding the H's(piers).
BUT THey got caught so the judge then required that ALL be allowed to play in any recoveries that may come out of this, so she sent the into negotiations.
Now DA BOYZ put on their thinking caps and IMPROVISED ADAPTED and OVERCAME, as they then came up with the 70/30 later to change to 75/25 by allowing commons to play where THEY SHOULD NEVER HAVE BEEN HISTORICALLY in any previous BK CASE.
Now IMHO in those negotiations it to was decided since commmons are never allowed to to participate UNTIL PREFERDS and all others are paid in full they changed it up a bit.
Then imho they said OK since you(commons) are playing where you should never have been playing, THEN AS WELL we as Preferds will for that consideration as well require that WE P's will be allowed to play where we normally are never allowed to play and that is PAST face to whatever amount that ends up being returned.
IMPROVISE ADAPT and OVERCOME.
Now the overall THEY NEGOTIATED themselves basically right back to the last man standing, but just less 25%

Now to FURTHER VALIDATE this scenario that Ps play to the end, ENTER THE UW's and a year after to play in the game as well, and they further validate there is STILL VALUE coming to P's in some form or fashion that PLACES THEM ABOVE COMMONS or they would NOT fight to maintain their positions in the P's and would HAPPILY MOVE to the commons, IF IF IF IN FACT it has NOW become apparent(TO SOME) that the COMMONS SHALL INHERIT THE ESTATE.
Their attorneys and accts can both interrupt the LAW CONTRACTS as well as the books.
ALl the did was to ADAPT and to OVERCOME being charged with IT, yet STILL AS THEY WELL KNOW will end up with the BULK OF THE ESTATE.
For any to actually believe they negotiated themselves into a bad or subordinate to COMMONS is LUDICROUS and extremely naive, they JUST IMPROVISED ADAPTED and OVERCAME and NOW HOLD 75% of something, where they could have easily been kicked to the curb.
One can not just wish LOGIC and COMMON SENSE away, to paint a picture THEY WANT TO SEE in spite of common sense or logic......
Forget what you own here and look at the over all information that has been shown that shows us at every turn they have ALWAYS DONE whatever it take to be LEFT STANDING HERE
