Yeah. I think it came down because of SOME profit taking/flippers but you're correct that it suddenly was NOT a slam dunk when the company(CONpany?) fought George on this.

If custodianship isn’t granted, it will be a matter of weeks until the shareholder derivative suit is filed. There are some jurisdictional steps that have to be taken before you can file (notice to the board and opportunity to them to deal with it, etc.).
