Defendants have abjectly refused to respond to the Rule 60 motion even though they acknowledge that under LR 7-2(d), the failure to respond to a motion typically “constitutes a consent to the granting of the motion"

in the context of Rule 60, a failure to correct clear error, constitutes an abuse of discretion

marjac, if SCOTUS wanted to review your Rule 24/60 materials, on their own prerogative, is there anything to stop them? Are your briefs part of the record?

I understand neither Amarin nor the Raiders of the Lost IP would likely make an argument based on your filings for their own reasons.

Wow marjac, well written, I see the language 'cropped' and 'fraud' and mistake made by the Judge that can be corrected etc etc. I bet Hikma wouldn't have a response because simply any response by them will drag them into opening the can of warms. In any case, looks like, ironically, Hikma lawyers are going to get sanctioned and don't know what Judge do will do with that con professor Heinecke. I have no mercy for them; I have lost literally everything everything because of their fraudulent activities.

..Hikma gave you the opportunity to reinforce your case and you sure took it -they shot themselves in the foot and so many times

It gave you the opportunity to really lay out and again what Heinke did and what the court were taken in by

It is incredibly compelling

It is clearly outside any legal reason or logic for this petition to be denied

Marjac, Any way we could get you on the BOD?

The shareholders owe you, BIGTIME!
The management team should reward you in some tangible way.
This may not be on your radar right now, but I hope if the
opportunity arises you would pursue it.
Rather than us disgruntled shareholders complain endlessly
seeking your representation on the BOD might be more productive
and very satisfying.

I realize that they already responded with basically "no comment" but if Du is really concerned that she was hoodwinked and is not comfortable with hearing it from the investors, she may order (or just ask) Amarin to comment to the substance of your allegations.

Marjac + Amarin would be an interesting alliance.

Thank you Marjac & Team for your relentless defence of your fellow shareholders. Just out of pure self interest let me request from you that you do take a day or two off to spent with family and friends and/or go out all alone into nature without a timetable to replenish yourself!
If you have done that would you adress my personal pet concern (with all due prejudice that your online posts are certainly monitored by Hikma counsel) which is wether a victory in your motion 60 (if the court recognizes that it has been defrauded) would open the door to civil damages litigation?
If a case of fraud would be established by Judge Du's decision would this establish Hikmas strategy to be a criminal act ?
Thus could it be that this would constitute "tortious / wrongful / malicious interference" against shareholders interests in the company?
Would that allow for a class action suit being brought against Hikma seeking redress for losses resulting from their criminal interference with bad intent?
I for one basically lost my retirement already depleted by punishing medical expenses capped by my insurer...
I am sure others on this board would show even larger losses to constitute for a class
