Not Amy, but I can try to answer (SCOTUSblog's contact form comes to my inbox). We can't know for sure. There is a lot of offline communication between the SG's office and the court. However, OSG has sent unsolicited letters to the court in eight or so other cases this term notifying them of the Biden administration's change in position in those cases, some after argument already occurred (see, e.g., the Affordable Care Act case). To me, it seems likely that this was just a routine update, unsolicited. Thanks, Kal
ROLG, tone it down a little, will ya? SCOTUSBlog follows this stuff as their day job. There are a million lawyers ... We like ya ... and you’re probs right ... conspiracy theorists would say the offline prompted the unsolicited- I am not one and believe the overwhelming probability is in your favor.
