I think it's simple, if one had funds to disburse in multiple and
varying portions and the very proportioning method was under ongoing and escalating litigation, how could one NOT hold off on the disbursement until the litigation/case is settled?

I am talking about his most recent rebuttal to Alice's claim. The rebuttal which is before the 3rd circuit. In his rebuttal he said that moving the UWs to Class 18 would prevent equity from receiving any further distribution. In addition, when Alice's claim was before the Bankruptcy Court, Judge Walrath asked Alice, how is it better to have the UWs in Class 18 ahead of equity? The fact is, it isn't. The reason being equity would be canceled in that event. This has to be settled before anything can move forward.
