Dude. It is perfectly correct GRAMMAR. It's a long sentence, and 'It appearing' is in the present tense and an 'active' phrasing.....(like 'In reviewing the order, I find that it is correct with regard to the choice of Grammar...' ......read it again...and look it up.....and have faith that a freaking JUDGE isn't gonna use the King's English incorrectly ......or me for that matter.......Bhhaaaa Bhaaa...lol
