In my opinion the SEC is a terrible government agency. They have the money and the influence to get help and undo the backlog. They keep extending decisions on most cases, just kicking the can down the road. This does not solve the backlog. Maybe if the SEC attorneys did their job, the judge would have had a different decision and the case would have been finished.
I just think DBMM management got lucky because of the poor presentation of the case, treating it like any other case, and forced to file a petition for review to cover their butts. Maybe the direction of the case was unusual, but the outcome may be the same. Some kind of hybrid final decision is the most likely outcome as stated by another poster. That is why it is taking so long. At some point it will be decided or back to court.
