VI. CONCLUSION
For the reasons stated above, the court dismisses plaintiffs’ claims because it lacks
jurisdiction to entertain their fiduciary duty and implied-in-fact-contract claims, and plaintiffs
lack standing to pursue any of their claims.
The court therefore GRANTS defendant’s motion to
dismiss. The clerk shall enter judgment accordingly.

That's assuming Sweeney has jurisdiction to hear derivative claims if defendants appeal. That is still unknown. She may have to punt that as well.
