Ouch, that's a good point. If Sweeney never allows any direct claims to go forward, no case against the warrants will ever make it to trial in her court.
As of right now, derivative claims for both common and pref shareholder plaintiffs have survived, and direct claims for both common and pref shareholder plaintiffs have been dismissed. That certainly doesn't bode well for Washington Federal or any putative warrant-challenging claims.
