I have been told 'No' cuz they have to have those shares available. But if they can tell a client when to buy and when to sell, I think they can pretty much do anything to cover their butts!

No link. However, I have been involved in this conversation on another stock. One where many called their brokers for clairification.

The brokers said that the shares should not be able to be loaned out as they were in sell "status", but the bottom line was as long as the brokers still showed them as still in the "margin" account they could still lend them out.

(It appears the brokers do what ever they want anyways, they all know that our accounts are full of naked shares, and don't give a dam)
