Actually, En Banc upheld that portion of Sweeny's ruling that NWS is not Cricket and severed the for cause removal clause from FHFA which has been appealed to the SCOTUS by both plaintiff and defendant.
SCOTUS is currently hearing parallel CFPB case with a decision to be announced by June this year that will decide all the other appeals in limbo by officially refusing to hear them. Then Sweeny will decide remedy for illegal NWS by unconstitutional agency and DJT will issue executive orders to clean up da mess :-)
