Yes and No, I think both are very difficult, if SCOTUS takes the case plaintiff will NOT settle and not give in a penny, and rather wait for the very damaging (for the government) verdict, (which by all means must be prevented, because in future downturns it will be devastating, as all investors will run for the hills and the government will be toothless as no investor wants to wait 12 years for justice)
If they do not take the case justice will not be served and more investors will be frustrated until a verdict is reached later this year, But more importantly it will frustrate congress, as the public opinion was formed by the government and what they preached for more than a decade, this will especially be hard as the frustration in some people is still very high and they just want to put them into receivership to get the case closed, (remember some of these people just run away with the thought of a very selective group without ever being informed on the misbehavior that took place)
So if I’m puzzling and put the fragile pieces together I conclude:
Investors want the MAX – so they want the SCOTUS to take it
FHFA wants control – and lost already but they are better off with a settlement then a loss, so they do NOT want SCOTUS to take the case
Treasury wants money – and lost big time already by sealing documents, they want to forget the issue ASAP, so they do NOT want the SCOTUS to take the case
Congress wants power – so they want the SCOTUS to take the case, but fail to understand this is a guaranteed total-loss situation for the government
President’s cabinet wants power – they do understand the situation they find themselves in and do NOT want the SCOTUS to take the case
The Judges want fairness – and do NOT want the SCOTUS to take the case, as it proves all judges before the SCOTUS verdict were wrong and that is a pretty poor as so many judges already did rule it was legal
The average man wants justice – and Do want the SCOTUS to take the case as it proves wall street is wrong, but since they were misinformed by the government it is just the opposite, so ones details start leaking on that, the opinion will quickly be adjusted, so it is not something to consider
Then it makes me believe SCOTUS will not take the case, as all the government related agencies pray for not accepting the case, but because they pray for it, the SCOTUS will probably take it, or does that sound flip flopping :-), LOL
Chances are 50/50 I really don’t know, your guess is as good as mine
