yes it is from the 5th circuit ENBANC, it is now back at judge Atlas and she will wait for the SCOTUS to take the case or she needs to rule herself if it is denied by SCOTUS
III. CONCLUSION We AFFIRM the district court’s order granting the Agencies’ motions to dismiss the Shareholders’ APA claims because such claims are barred by 12 U.S.C. § 4617(f).
