Yes Rick, the 11,000 documents are part of the treasure trove that Sweeney allowed in her court. Other courts did not get to the discovery phase as the judges felt that plaintiffs (shareholders) had no standing based on Lambert’s interpretation of HERA.
My understanding is that the 11,000 documents have been shared with all the plaintiff’s lawyers and apparently some judges as they were quoted in the en banc hearing and decision. The order that just came out, in my understanding, is that Lambert is now allowing these 11,000 documents in his court. If plaintiffs’ lawyers request additional documents, these will also have to be made available.
