Nope you should do the filing ASAP. Don't take a chance.
I bought more than 25% shares of a company that had OS listed as 2 million I knew the OS has to be a lot more and my portion is a tiny % and didn't file 13G. Got a love letter from SEC. Big trouble. Then did the 13G filing.
Then I went after the company asking them to disclose the real OS and made SEC send them a letter too. Finally, the company was forced to disclose that the OS was 2 billion.
Then when I discussed with the bigwigs at SEC, how the hell it is my fault, no one could do anything. They said that is the law now. The law must be changed.
Finally, I reached the SEC Chairman and he asked me to write a petition. I did send that to the SEC chairman and to the "Senate Committee on Finance". No one has done anything yet. Assholes.
