1) As you mention correctly the government can put google as easy into conservatorship as FnF, just a matter of forcing, and doing the opposite of what they should do, and claim any document is sealed in the future, is it correct, no probably not, will google investors receive damages, most likely, will it set a bad precedent most likely, so here we are

2) Yes I do think current shareholders need to be made whole, the government does not want a “keep your hands off” “do not touch, the government will sweep your money as soon as they can” company, investors can pick from thousands of investments and will not choose FnF, if there is even a little doubt their money can be confiscated in the next downturn, so they will not live with it, but choose not to invest in FnF, the longer it takes the higher the compensation, no compensation, no investors IMO, you are right about the risk, higher risk will drive down the offering, and thereby make the company less profitable, so investors will choose another company to invest in and FnF have a hard time paying dividend on prefs, and cannot issue new prefs, and common stock will have no upside potential or dividend, and the downward spiral to zero is started

3) As for the maybe hoax, one thing will lead to another, if the NWS is illegal (as it is IMO) the whole conservatorship is unsustainable, and if they proof by documentation their status was worrying and the transcript of the meeting of the then board of directors agrees, and the 12.000 documents are released and no wrongdoing flows out of these documents then maybe just maybe they can uphold conservatorship, but not the NWS, so the 16.1B you mention, either way will not be enough to compensate FnF and shareholders

4) Treasury indeed has no incentive to void the SPS and warrant, but most likely will be “forced” :-) into it, by the courts, as the current catch 22 is unsustainable
