No, they can file at any time.

Another nice fact is that they are piggyback registered which allows them to uplist by way of electronically filing.

This speeds up the process to get back on the OTC significantly.

Not at all, boon. Once they have up-to-date, audited financials. They will need to obtain a CIK # to file them with the SEC and file a Form 10 (all on-line) and they can uplist. This is likely as long as they remain "piggy-back" qualified. They do not have to file an SB-2 with can take considerable time in 30 day increments at the discretion of the SEC.
