Understood. This is why I come back to the fact that VDK is a license. A license is a permission. No one needs this permission any more because the patent has expired.
I think the situation would be different when the patent was still live. Then an exclusive licensee might be able to say they have standing on a claim of patent infringement if Tmmi had generated something that was infringing Iterated patents. But as you and I agree, that issue is moot.
