While I agree with your risk assesment, it is always a risk speculating, it wasn't an honest mistake.
How do expect Amstar will be able to sell $5 shares on the Pinks? Who do you expect will pay that much for shares in a market that requires no disclosures or filings from the company to back up their claims?
There won't be much of a market for the stock at that level. It won't be long before it comes right back down to the current level with a small number of shares outstanding. If this were an IPO on the NASDAQ, it would be a totally different story, the way it is now it doesn't benefit anyone, including Amstar shareholders.
