No. They are also BANKRUPT. They couldn't buy back a single share while in bankruptcy.

The claims that the company is buying back shares are complete fiction. They are impossible and not based on anything factual.

And the claims that anyone else involved in this bankruptcy are buying up BIOAQ shares are also completely fictional and impossible, not to mention they would be ILLEGAL.

I'm remote or I'd research an answer MrT.
I know that Bioamber can't dilute right now and per court order they're not required to stay up-to-date with SEC filings since BOD is gone.
Maybe someone versed in CCAA proceedings can advise.

I’m mobile for now also but based on what I read last night in the documents generously provided by 10Kay there are exceptions to the impaired capital claim as well as a loose definition of impaired.

Also regarding the reporting by bio inc if they were buying back shares - I haven’t dug as deep as I’d like to yet - but what I did come across was that they would only be required to report it on their 10Qs and 10Ks. I will have to redig for that later.
