BioAmber Inc. pwns the patents and controls the stock. So do not be too fast to assume their importance in this. In the monitor's report it was stated and correct me if I am wrong, the Canadian side would not enjoy the payout from the US owned assets, so debtors will not get paid from those assets. That would have to be applied for separately.
