People have to understand the significance of this Claim Construction Order from USITC...
Netlist patent infringement case against SK has now been found favorable by both USITC and Judge!
Netlist also filed additional suits in Germany and China against SK and soon Netlist could even order an import ban on SK Hynix semiconductors...has to be finalized yet before doing that, but I’m thinking all formalities at this point.
Quick recap from article... -USITC already sided favorably with Netlist which sent case back to judge -Judge already sided favorably with Netlist regarding key claim construction orders @ heart of dispute -Now USITC and Judge have to determine if SK infringed later this year, however they’ve both already sided favorably with Netlist in the petition for case to be reopened, which now it is and looking very good for Netlist, AND very unfavorable for SK now that aspects of this case have been further defined and clarified
It seems all that’s left to settle with ITC and Judge is formality of legal process imo...then settlement!
