you could ask them if they plan on filing with the sec at or about the time they make this "update." i still believe that would be immaterial. but if they stated this update would contain juicy material change matter when we announce it shortly publicly, tbat would be pushing it if at this time they made no official filing. but if they filed a 10k or 8k or 4k or 10q whatever that is, and said the same thing at or about this time, that is still ok. its that they kept it broad and immaterial
and not requiring any filing because if it did itd be no big deal just to make that filing if it were that close.
